By admin on July 9, 2011
I was travelling over a roundabout, a car pulled out from a junction with no warning and I hit it. I was travelling straight on and had right of way. Other driver has just withdrawn their claim for damage against me, which might give me a better chance, I assume they must have withdrawn for a reason. I’m 3rd party insurance only so have to claim myself. What are my chances of going it alone against a big insurance companies legal team and claiming successfully for this type of accident? Any pointers on where to start? Ta !

Submit the claim and see how it goes. You can always get an attorney if you need help. Do you have a police report that supports your case? If you do it might be a very easy claim. If it comes down to ‘he said, she said’ you might run into problems.
Good luck on going against them. Make sure you have a copy of the accident report in hand when you contact them. Did your vehicle get towed away from the scene. If so, the company that towed it or impounded it might help. Try to get at least 3 estimates to call with too. Check with the county clerks office in your area to see what forms you need to have filed. You can get most files at the local library. A lot of the insurance companies have changed in the past few years for the better.
You can file a claim against then. Whats the worst that can happen they say no? We do it all the time for clients. Remember to claim a littler higher because they will want to neg it down.
“YOU HIT BACK YOU PAY BACK”
It depends on the the laws of the country within which you are located but normally anyone that hits a person from behind is at fault for not having a safe distance, however; experts can usually tell from the angle of which you have been hit if someone had pulled up suddenly in front of you.
