Ten days ago I was hit in the back of my car by a 18 wheeler. The driver of the truck admitted fault and I am assuming the police officer agreed. What happened was a car in front of me was slowing down to make a turn so I was slowing down and traveling approx 20 MPH when the 18 wheeler hit me from behind. It jarred the car hard enough to cause the moon roof to open up. It also poke two holes into the back of my car , (his front end had some kind of spike like decoration) and you can see where the paint has a crack line. It also left a mud imprint of his license plate. I also had my 3 year old grandson with me (who was in his car seat and doesn’t appear to be hurt). The adjuster/insurance agent has been unable to come out until tomorrow. What should I expect from the insurance adjuster? They also want to talk to my son who is the father of my grandson. One more thing, I am leasing the car I was driving until 2011. I don’t want anything I don’t deserve, but I also don’t want to have to pay for something later on related to this accident.
On a lease, make sure you have it repaired by the dealer. This way they know there are same parts on the vehicle.
As far as your grandson, yes, they will need to speak with the father of the child since he’s a minor.
Your very lucky you weren’t injured and I have to give kudos to you in regards to that. Not all, but most people would be going for the throat and trying to get rich on a settlement.
What their liable for is pain/suffering, lost wages and medical. If there’s no injury you will normally get a small settlement for general damages only. Remember, you have a choice of where your vehicle is repaired and it’s important on leases to stay within the dealer/manufacturer on this one.

My wife had a simular situation some years back. I would tell you NOT to make any settlement arrangments with the adjuster until AFTER you talk to a lawyer. Just because you and your grandson feel OK now, doesn’t mean there aren’t any underlying injuries. Only agree to have them pay for the repairs…nothing else! Read the fine print. Once you sign any release paperwork from the adjuster, If anything should pop-up in say a month, it will be too late to suit for medical treatment. Good luck, Glad your both OK!!
it’s called failer to control speed on his part, you should be compinsated for damage. and he should have been ticketed for the accident.

#1 Get a lawyer
#2 Notify the insurance company you have a lawyer.
#3 Let the lawyer handle everything.
