five days ago I was hit by a Toyota Tundra riding my motorcycle to school. I was doing 55 in a 55 and he pulled out in front of me hitting me at 55mph with the right front of his truck. There my leg was crushed in between the bike and the truck, I traveled 100 feet, not exaggerated, and my bike went even further becoming totaled. EMS cut clothes off you know what happens, emergency room and then home after 8 hours. I didn’t have any broken bones but my left leg’s muscles are crushed. I got 6 stitches in my left knee along with two other cut receiving two stitches each. Road rash all over my body, I was wearing a helmet and it saved my life. Ive been at home since. I cant walk by my self crutches are hard because I can’t lift my leg high enough off the ground to move with the other. the doctor said I would be walking alone maybe by Christmas. The man’s insurance is covering the everything but i want to know how much money is all of this worth? the pain and suffering? I have no idea?
I would get advice from a lawyer/accident attorney. They will be able to assist you most accurately and determine what you should be able to get.
Or call your insurance agency.
I am almost positive that you should never let the other people’s insurance agency determine anything- because they will try to get away as cheaply as they can.
Good luck and I hope you recover soon!
Take the blessing that you were not killed. Is it really worth suing someone else? As long as all of your doctors bills are being covered, then I wouldn’t worry about the rest. Think about if you were in his shoes. He might not have seen you, or something else could have been going on.
IDK… that’s just my thoughts. You have know idea what troubles this man has/is going through. He might be out of a job, his wife/mother/sister/child might be sick. Do you really need money for pain and suffering… I mean, your medical bills might not have even been covered.
it seems to me you are receiving the proper amount of insurance coverage. No one ever said life was free of pain or suffering.
Heal quickly, good luck
If you intend to sue him, it’s really just an estimate how much you get. Get your bike damage, hospital bills, and if you have a job, calculate how much you make between the accident till when you’re supposed to walk again add in 2 more months of pay from work. Max you could get before the judge thinkgs you’re just doing it for money is 10X the amount of all that.
BTW since you’re being covered by his insurance, you will not be able to sue him by that much since you’ve accepted the money.
I don’t think there are any specific formulas for pain and suffering, but given you didn’t have any serious injuries, I doubt you would be able to recover any significant amount. In order to protect yourself, you should avoid any kind of settlement until after you are up and walking again. If you once the initial swelling starts to go down and the bruising starts to go away, you’ll want to make sure you don’t have anything like an ACL injury – if anything feels just a little off, make sure you see a doctor to get it checked out.
Assuming you don’t have any injuries beyond the bruising and road rash, and assuming you don’t miss too much time from work, I would guess you’re payment for pain and suffering would be less than $10,000. But the guy’s insurance will have to cover your bike, any related medical bills, any time lost from work, and some amount for pain and suffering.
The reason you don’t want to settle too quick is in case you find out in a month that you have some kind of internal injury requiring surgery, it won’t be covered. As long as the guy’s insurance company is cooperating when it comes to paying the medical bills, you probably don’t even need to get a lawyer.
Oh man-alive!!!
I really feel for you, guy
Sorry to hear you’re in agonizing Pain.
Just the thought of a person Flying a 100 ft. at like 50 to 55 mph gives me the chills.
The PAIN is lots harder to bare…….Heck with the $$$.
If you don’t have any broken bones & no permanent damage, I would think 5000-10000.
My son was in a car accident, and suffered a badly broken femur, knee damage a concussion. He had problems with his leg healing, and required 6 surgeries. He wasn’t able to work for 3 yrs.
His pain & suffering were well over 6 figures, but compare the injuries and you get a rough idea
