hi guys,
i was in a three car pile up-accident last month. i searched on google already and did not find answers for my specific situation. anyways what happened was basically the first car slams on her breaks when the speed at which we were travelling was probably 60-70 km/h. So it was very difficult to stop and the 2nd car tries to stop but couldnt due to the speed and hits the lady. i was the 3rd car and i couldnt stop either so i hit the 2nd car. i wanted to know who pays for which damages?????
and this is in CANADA in case the laws are regarded differently in different countries!?!?!
ive been really busy and haven’t had the chance to really do anything and that is why i havent called my insurance company yet. i wanted to know whos at fault before i do that.
thanks in advance
ohh and the 2nd car budged in front of me about 30 seconds before the accident so i had enough room and was not travelling too close to the other car
wel not sure about there but here if anyone stops for any reason any where and you cant stop then either you was going to fast or was too close or both and your fault
The technical answer is that you could ALL be held liable. the first car could be held liable for reckless or irresponsible driving, and then both of you who rear ended the car in front of you would be liable for that.
However, it may just be up to a judge or local authorities to determine what the out come will be.
did you get a police report sounds like the third party is at fault because again traveling to close to fast why did the first car stop so fast was it the traffic if it was the last two was at fault
Don’t know about Canada, but in at least the US states I have lived in the doctrine is that each car is responsible for damage to the one in front of it on the theory that the driver should have controlled their car (slower, more following distance, etc). I would expect similar policy in most countries.
it,s the 2nd and 3rd cars fault because they hit the car in front of them in the rear. it tell you that you have to have your car under control at all times.
