I was going to work this morning. I was entering a four lane on ramp into downtown. The on ramp combines two lanes from the freeway and two from other areas. I was originally in the number 3 lane, and needed to get into the number 2 lane – as I do every single day. Traffic was a bit heavier today so it was moving very slow. I noticed that no one was in the number 2 lane, so I threw on my blinker and merged behind a red car and came to a stop. A Ford Expedition that was in the number 1 lane then merged into my lane and side swiped the back corner of the driver’s side of my car. I had my blinker on when I merged. I did not cut anyone off. She clearly was not traveling at a safe distance or she wouldn’t have hit me. I called her insurance and filed a claim – and then she filed one with my insurance. How can I be at fault???
Because she is trying to make you pick up the check for her screw up. Dont listen to that “its her word against mine” because it isnt and thats a bunch of crap. If you have a witness then you dont have to worry at all, and even if by some crazy ass fluke no one saw it happen, do you know how many cameras there are around. A lot. So what if that stupid bitch filed a claim, she aint gonna get far, ill tell ya what.
Trust me, i would just tell the insurance what happened and they will take care of it. I mean if your car still has a mark form it, which im guessing it does, they can tell by the way who hit who. So you’re fine. She is just a bitch who doesnt want to pay for her own stupidity
Whoever side swiped you is going to try to lie their way out of it and put you at fault, but if you were being a safe, defensive driver and merged into the next lane when it was safe, it was her fault
Who got the citation?
If she bumped you and she was behind, I would think it is her fault.
It looks like you’re screwed on this one. The damages look like you moved into someone else’s lane. And since the damages aren’t on the whole side of your car and just the back corner doesn’t help your claim any. Unless you were looking in the lane you changed into the whole time you were moving in it, how do you know the other car didn’t move in it 1/10 of a second before you did? Since it doesn’t sound like there were witnesses, weather you had a blinker on can’t be proven. You can say, “I did not cut anyone off. She clearly was not traveling at a safe distance or she wouldn’t have hit me.” all you want, but that sounds like your angry talking. It should be 50/50 fault based on your description of the accident, but the way the damages look would probably put more than half the fault on you, sorry. Your insurance company would protect your interests and defend you if it comes to that.
